Madonna has filed to dismiss a lawsuit submitted by concertgoers after one of her ‘Celebration Tour’ concerts started hours later than scheduled.

The filing came after the Queen of Pop began her show at the Barclays Center in Brooklyn, New York on 13 December at 10.30pm – two hours after the advertised 8.30pm start time, according to the papers.

Subsequently, concert-goers Michael Fellows and Jonathan Hadden began legal proceedings, claiming the delay was a “wanton exercise in false advertising, negligent misrepresentation, and unfair and deceptive trade practices”.

In their motion to dismiss, however, lawyers for the Hung Up singer insisted that a two-hour delay does not warrant a lawsuit, writing: “Plaintiffs speculate that ticketholders who left the venue after 1am might have had trouble getting a ride home or might have needed to wake up early the next day for work

“That is not a cognizable injury.”

Additionally, they claim that, prior to filing the lawsuit, one of the concertgoers “raved” about the “incredible” show in a Facebook post.

“Nowhere did Defendants advertise that Madonna would take the stage at 8.30pm, and no reasonable concertgoer – and certainly no Madonna fan – would expect the headline act at a major arena concert to take the stage at the ticketed event time,” the lawyers continued (via People).

They added that both fans “got just what they paid for: a full-length, high-quality show by the Queen of Pop”.

It comes as Madonna prepares to end her ‘Celebration Tour’ with a free concert in Brazil on May 4.

Closing out the run, the Express Yourself singer will play the show on Copacabana Beach in Rio de Janeiro, Brazil, which “will be free of charge as a thank you to her fans for celebrating more than four decades of her music over the course of the epic global run of the tour.”

Taking place in front of the Belmond Copacabana Palace Hotel, no tickets are required and admission will be on a first-come, first-served basis.

Billed as Madonna’s “biggest show yet”, the concert will be broadcast live on TV Globo.
