Britney Spears’ lawyer Mathew Rosengart has filed a petition to remove her father Jamie as conservator.
The singer’s attorney filed the petition in a Los Angeles court on July 26, less than two weeks after he was appointed.
According to the New York Times, he cites a section of the probate code which gives the court the power to remove a conservator if it “is in the best interests” of the conservatee.
He added that “serious questions abound concerning Mr. Spears’ potential misconduct, including conflicts of interest, conservatorship abuse and the evident dissipation of Ms. Spears’ fortune”.
In addition to her own legal fees, Britney is also covering Jamie’s fees in the case, along with his fee as conservator.
The filing aims to replace Jamie with certified public accountant Jason Rubin as the conservator of the Toxic singer’s estate, which includes cash assets of $2.7 million and other assets of over $57million.
“There might well come a time when the court will be called upon to consider whether the conservatorship should be terminated in its entirety and whether – in addition to stripping his daughter of her dignity, autonomy and certain fundamental liberties – Mr. Spears is also guilty of misfeasance or malfeasance warranting the imposition of surcharges, damages or other legal action against him,” said Rosengart.
Jamie’s representatives have denied the allegations made by Britney and insisted he would not step away from the conservatorship when Rosengart called on him in court to voluntarily resign.
Admitting she’s been left “traumatised” and “depressed”, last month Britney pleaded with a Los Angeles judge to call time on the conservatorship, and shared her wish to cut ties with her father and open legal proceedings against her family.
Off the back of the hearing, the Work B**ch hitmaker was granted permission to select her own legal counsel, following the departure of court-appointed attorney Sam Ingham.
